## Learning goals

- Distinguish premium, surrender value, event benefit and collateral value.
- Identify the right acquired under a security instrument.
- Analyse enforcement through claimant, priority, deductions and date.

## Reading guide

Policy issue creates contractual rights whose incidents depend on the policy and governing law. An economic contribution to the premium does not automatically allocate a proportional proprietary interest in those rights. The relevant value also changes with the question: a death benefit, present surrender entitlement, policy-loan capacity and lender’s recovery estimate concern different rights and assumptions. Assignment, notice, registration, priority and realisation require their own analysis. The chapter connects these matters without allowing a regulatory classification or a marketing illustration to determine private-law title.

## 90-minute seminar

- **10 minutes:** Recall the assigned reading and define the decision to be made.
- **20 minutes:** Discuss the reading guide and test its distinctions against the text.
- **25 minutes:** Work in pairs on the constructed exercise, recording missing evidence.
- **20 minutes:** Compare reasons with the facilitator commentary and challenge an inference.
- **10 minutes:** Debate the challenge question using a specified rule or evidence gap.
- **5 minutes:** Complete the exit task and identify a source to revisit.

## Constructed exercise

A fictional file lists a death benefit of 1,000,000 units, current surrender value of 620,000, secured debt of 310,000 and assumed realisation costs of 15,000. A lender’s internal collateral estimate is 500,000. Identify which numbers answer which questions. Calculate the purely illustrative residual using surrender value, debt and costs, then list the legal assumptions needed before anyone could claim it.

## Facilitator commentary

The arithmetic residual is 295,000 units. It is not an entitlement or recovery forecast. Its use assumes the stated surrender amount is currently payable, the debt and costs are correctly identified, no other deductions or competing interests intervene and the claimant has the relevant right. The death benefit concerns a different event. The lender’s estimate is a valuation assumption. Identify assignment terms, notice, priority, policy conditions and the person entitled to any surplus before reaching a legal conclusion.

## Challenge for discussion

How could a formally accurate valuation still mislead a client about accessible liquidity?

## Exit task

Produce a four-row table pairing each value with its claimant, event and source document.
